Terms of service

These terms are written in plain language for our beta and launch. They have not yet been reviewed by a lawyer. Sections marked Pending legal review are especially likely to change before or after review.

These terms apply when you use the Wish & Wrap iPhone app, the web app at wishandwrap.com/app, shared shopping links, and this website (together, "Wish & Wrap"). Wish & Wrap is operated by Josh Tipton ("we", "us"). By using Wish & Wrap you agree to these terms and to our privacy policy.

1. Who can use Wish & Wrap

• You need to be 13 or older to create an account.
• If you're 13 to 17, you need permission from a parent or guardian. Pending legal review
• Children under 13 can't have their own account. A parent or guardian can add them as a profile and manage their list. By adding a child, you confirm you're their parent or legal guardian, or have their parent's permission. Pending legal review

2. Your account

You sign in with a one-time code sent to your email. Keep access to your email account secure, because anyone who can read it can sign in as you. Give us accurate information and let us know at [email protected] if you think someone else has used your account.

3. Families, sharing and permissions

• Families are groups you create or join with an invite. The person who creates a family can manage who's in it.
• You choose who can see your lists, and can hide individual wishes from individual people. Shopping activity, like reservations and purchases, is shown to other shoppers and never to the person the gift is for.
• Shared links let people view or shop a list without an account. Anyone who has the link can use it until it expires or you turn it off, so share links only with people you trust.
• Only add people and information you have the right to share, and be thoughtful about what you add about others.

4. Using Wish & Wrap responsibly

Please don't:

• Post anything illegal, hateful, harassing, sexually explicit, or that infringes someone else's rights.
• Use Wish & Wrap to send spam, scrape data, or get into accounts or families that aren't yours.
• Interfere with, overload or try to break the service or its security.
• Use the service to sell products or run a business without our written permission.

5. Product information and availability

Product names, pictures, prices, store suggestions and other details in Wish & Wrap come from what you and your family enter, from retailer web pages, from product databases and from automated tools that try to identify items. This information can be wrong, out of date or incomplete. Prices and availability change often. Always check the details on the retailer's site before you buy.

6. Buying from retailers

Wish & Wrap does not sell products. When you tap a store link, you leave Wish & Wrap and go to an independent retailer. Your purchase is between you and that retailer, under the retailer's own terms, prices, shipping, return and privacy policies. We don't process payments, we can't see or change your orders, and we're not responsible for retailer products, delivery or customer service.

7. Affiliate relationships

Some store links may be affiliate links, which means we may earn a commission from the retailer if you buy, at no extra cost to you. Commissions don't change what's on anyone's list or the order stores are shown in. Details are in our affiliate disclosure.

8. Your content

Wishes, notes, photos and other things you add stay yours. You give us permission to store, process, display and share your content only as needed to run Wish & Wrap for you and the people you share with, for example showing your list to your family or sending a product photo to our item-recognition service. This permission ends when you delete the content or your account, except for copies kept for a limited time in backups. Pending legal review

9. Our content and brand

The Wish & Wrap name, logo, app design and software belong to us. You may use the app for personal, non-commercial purposes. Please don't copy, modify or resell it. Retailer names and trademarks belong to their owners and are used only to identify stores.

10. Ending your account

You can delete your account at any time in the iPhone app under Settings, or by emailing us. We may suspend or close accounts that break these terms or put others at risk. If we discontinue Wish & Wrap, we'll try to give reasonable notice.

11. Disclaimers Pending legal review

Wish & Wrap is provided "as is" and "as available." We work hard to keep it running and accurate, but we can't promise it will always be available, error free, or that a surprise will never be spoiled, for example if someone shares their screen or a link.

12. Limitation of liability Pending legal review

To the extent the law allows, we're not liable for indirect or consequential losses, or for problems with products, prices or services from retailers or other third parties. Nothing in these terms limits rights you have under consumer protection laws that can't be waived.

13. Governing law and disputes Pending legal review

The governing law and how disputes are resolved will be set out here after legal review. Until then, if you have a problem, please contact us first at [email protected] and we'll try to sort it out.

14. Changes

We may update these terms. If a change is significant, we'll let you know in the app or by email before it takes effect. The date at the top shows when they last changed.

15. Apple

If you got the app from Apple's App Store, Apple isn't responsible for the app or its support, and Apple's standard terms for apps also apply. Pending legal review
